Terms of Service

1. Who can open an account

You must be 18 or older and pass identity verification. Accounts are available to individuals and businesses lawfully resident or incorporated in the United States. We verify identity using a government-issued ID before any account is fully activated, as described in our Personal Banking and Business Banking pages.

2. Your responsibilities

Keep your login and card safe, and tell us fast if something's wrong. You're responsible for keeping your password and one-time codes confidential, and for reporting a lost card or unauthorized transaction as soon as you notice it. Delayed reporting can limit how much of a fraudulent transaction we're able to reverse.

3. Fees

Fees are listed on our Rates & Fees page and won't change without notice. We'll email and post an in-portal notice at least 30 days before any fee increase or new fee takes effect on your account type.

4. Holds, freezes, and account closure

We can hold a suspicious transaction or freeze an account while we investigate. Grounds include suspected fraud, a legal or regulatory order, or a significant, sustained negative balance. We'll explain why whenever we're legally able to. You may close your account at any time with a zero or positive balance; we may close an account with 30 days' notice for any lawful reason, or immediately in cases of suspected fraud or illegal activity.

5. Liability

We're liable for our errors; you're liable for negligence on your end. If we make a processing error, we'll correct it and make you whole. We are not liable for losses caused by sharing your credentials, ignoring a security alert, or continuing to use a device you know to be compromised.

6. Dispute resolution

Start with our support inbox — most disputes resolve there. Unresolved billing disputes follow standard Regulation E / card network dispute procedures. Disputes not resolved informally are subject to binding arbitration in the state of New York, except where prohibited by law.

7. Changes to these terms

We'll tell you before anything material changes. Material changes are communicated at least 30 days in advance by email and in-portal notice. Continued use of your account after that date constitutes acceptance.

8. Governing law

These terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.
